TGEOWA - General Election - September 2017

Communication on 19th August 2017

Dear Owners & Residents,

I am honored to be appointed as the election officer to ensure a fair and seamless office bearers' election for TGEOWA on 3rd September'17. 

As per the Bye Laws, we need to follow certain rules and regulations in order to maintain unmitigated decorum throughout the election process. Additionally, there are few house rules which have been implemented in favor of further betterment of the association and establishment.

Kindly find the attached election related documents. General rules and regulations (Appendix E) are mentioned below for your reference; request all to go through the details. In case, there is any concern, please feel free to reach out to me directly for clarification.

Nomination (Appendix A)
1. Owners willing to contest for election has to fill the “Appendix A - Nomination Form” and submit the nomination form in person or by email by 5 pm, 27th August’2017 to the Election Officer.
2. Nominations are open for 1) President 2) General Secretary 3) Treasurer and 4) Joint Treasurer
3. A candidate may apply for multiple positions.
4. Existing Office bearer are not eligible to contest the election.
5. Only registered flat owners are eligible to contest the election not any member from their family as per the Bye Laws of TGEOWA.
6. All nominees must be a registered owner and should present ownership document at the time of filing nomination. If filing nomination by email, then nominee must share soft copy of ownership document by email and he/she is successful in election then the hard copy documents needs to be submitted before taking charge as office bearer of TGEOWA.
7. Those who have fully paid their TGEOWA association dues / have no dues on their flats are only eligible for contesting the election.
8. If any candidate is applying for President or General Secretary position; he/she must submit detailed primary agendas and course of action till August 2018 (Minimum 10 points agenda) to election officer at the time of submitting nomination. This will help the voters to judge your candidacy.
9. Final nominations will be published by 28th August’2017.
10. In case, there is only one nomination filed for any open position then there will not be any voting conducted for that said position.
11. In case, there is no nomination filed for General Secretary/Treasurer/Joint Treasurer positions then newly elected President may appoint individuals on said positions in consultation with core committee members.
12. In case, there is no nomination filed for President position then current core committee members will unanimously appoint an individual on said position.
Core Committee
1. Currently, there are 7 core committee members.
2. Newly elected office bearers will be added in core committee till August 2018; if they are not already part of existing core committee.
Proxy (Appendix B)
1. Anyone not able to come and exercise their votes physically can nominate other residents/ apartment care takers/tenants to vote on their behalf. But to exercise this the owner must fill the “Appendix B - Proxy Form” and submit it to the Election Officer before the Election Day or present at the time of voting.
2. If owner submits online vote directly then proxy voting will be dismissed.
3. Proxy form will be required for each flat separately.
4. Proxy voting is allowed for maximum of 4 flats by any individual.
5. Only hard copy of proxy form will be accepted and to be presented at the time of voting.
Voting (Appendix C and D)
1. Physical voting
a. Residents and owners should walk in to the TGEOWA office on 3rd September’2017 between 10 am to 2 pm to cast their votes. Ballot Papers will be available in TGEOWA office.
b. Those who have fully paid their TGEOWA association dues and have no dues on their flats are only eligible for voting.
2. Online voting
a. Anyone who is not able to attend and exercise their vote in TGEOWA office allowed to submit the “Appendix D - Online Voting Ballot” form on the election date from 10 am to 2 pm by email to the election officer only.
b. Any online voting before or after mentioned voting window will not be counted.
Election Results           
1. Election results will be declared on 3rd September’2017 by 5 pm.
Charge Handover
1. Charge handover will be done by 6th September. Where the newly elected office bearer needs to go to Sub Registrar office and SBI to complete the handover formality.
Election Timelines
  1. Appointment of Election Officer - 14th Aug’17
  2. Circulation of Nomination forms and Rules- 21st Aug’17
  3. Nomination Deadline- 27th Aug’17
  4. Final Nomination Announcement – 28th Aug’17
  5. Election Date- 3rd Sep’17 10 am to 2 pm.
  6. Result- 3rd Sep’17 by 5 pm.
  7. Handover to newly elected office bearers – By Sep’17 week 4

    #1: Refer Bye Laws Page 16, 2nd last para.. "Only Resident members may contest elections for positions within the Managing Committee"..
    Question: People who are not living in Golden Era cannot stand for elections that includes me (in Trinity Sunrise) and same for anyone else even in Bangalore.?.

    Any registered owner can stand for the election irrespective of current living address.

    #2: Refer Bye Laws Page 16, last para " In interest of continuity, the outgoing President of the Mangaement Committee shall be automatically nominated as a member of the new Mangaement Committee, subject to his own availability and acceptance..
    Question: Does this hold true at TGEOWA for this election?.. Does the President decide after elections results or before Nominations are submitted or declares after Nominations are declared.. such timings can have a lot ramifications..

    Unable to establish the correlation between highlighted Bye Laws and stated question. Simplifying basis my understanding of the concern - there is no management committee in TGEOWA; there are office bearers and there is a core committee. If exiting office bearers are not part of the core committee then they'll not be involved any longer. In current scenario, exiting office bearers are part of the core committee therefore they'll continue to remain in core committee.

    #3: Refer Bye Laws Page 14 Last 2 line followed into Page15, Top line.. "No Proxies shall be permitted for voting in such election."..
    Questions: Based on Rules and Regs of Elections sent by election Officer states proxies are valid which one holds true Bye Laws or Election Officers email?..

    Proxy is valid. Shared rules and regulations regarding proxy will be strictly followed throughout the election.

    #4: Does each voter get to vote for all 4 positions ie: one vote for each position..

    Each voter gets to vote for all open positions.

    #5: Refer "Rules and Regs" Page 1 under Nomination #4: "Existing Office Bearer are eligible to contest the election"
    Questions: Can existing office bearers run for other posts ie: Current Treasurer run for President's post etc..

    No, in current scenario existing office bearers will not contest for any of the posts. As current office bearers were not elected at the time of appointment for last cycle therefore their candidacy is invalid for upcoming cycle. However, in 2018 election we should look at modifying this rule otherwise availability of willing individuals will be limited.


    #6: Do all 7 core committee members resign and 4 get elected and who chooses the remaining 3 non elected members (assuming the last Prez chooses to quit completely. see #2)

    Existing core committee will never change as long as they are registered owners. Office bearers will be added to the core committee for their working period.

    Example:
    1. Existing 7 core committee members + Newly elected 4 office bearers (none part of existing core committee) - Total 11 core committee members
    2. Existing 7 core committee members + Newly elected 4 office bearers (1 already part of existing core committee) - Total 10 core committee members

    #7: Can Mr. Raju run for a post in this election as he was in the current committee as a Treasurer for a short time after which he resigned.

    By general rules of the election he can not as he was an office bearer in the last cycle, the same rule applies on him as well. If resignation is to be considered as a differential factor then all current office bearers would resign as well to contest again. Having said that, as an election officer, I would like to make an exception here and allow Mr. Raju to nominate himself for any of the open positions.
